1. Overview

OnlyAI.fm provides AI music radio, discovery, and creator tooling. By accessing or using the platform, you agree to these Terms of Service (“Terms”). If you do not agree, you may not use the service.

2. Creator rights & content ownership

You retain full ownership of your music and associated rights. Uploading or submitting content does not transfer ownership to OnlyAI.fm. There is no exclusivity requirement and creators may distribute their content elsewhere.

3. License grant to OnlyAI.fm

By submitting content, you grant OnlyAI.fm a worldwide, non-exclusive, royalty-free license to host, stream, display, and promote your content on the platform and its marketing channels. This license exists solely to operate the service and can be withdrawn by removing your content or contacting support.

4. Content standards & prohibited use

You agree not to upload content that infringes third-party rights, violates law, or is misleading about AI provenance. OnlyAI.fm may remove content that violates these standards or fails compliance checks.

5. Moderation & takedown (Notice-and-Takedown)

OnlyAI.fm may moderate, restrict, or remove content to ensure legal compliance. Rights holders can submit a notice-and-takedown request with: (a) identification of the copyrighted work, (b) the specific OnlyAI.fm URL(s) of the allegedly infringing content, (c) contact details, (d) a statement of good-faith belief, and (e) a declaration under penalty of perjury that the notice is accurate. We may request additional verification before acting.

Counter-notices may be accepted when appropriate. Repeated infringement or abusive claims may result in account restrictions.

6. Attribution & metadata

You agree to provide accurate metadata, including creator identity and AI tooling used. OnlyAI.fm may display this metadata to listeners and partners.

7. Accounts & security

You are responsible for maintaining account security and for all activity under your account. Notify us immediately of any unauthorized use.

8. Sponsorships & promotions

Sponsorship placements are subject to availability and separate agreements. There is no guarantee of exclusive placement or performance metrics unless explicitly stated in a signed agreement.

9. Disclaimer of warranties

The service is provided “as is” without warranties of any kind. OnlyAI.fm does not guarantee uninterrupted access or the availability of any specific track, creator, or feature.

10. Limitation of liability

To the maximum extent permitted by law, OnlyAI.fm is not liable for indirect or consequential damages arising from your use of the service.

11. Changes to the service

We may update these Terms or the service over time. Material changes will be communicated through the platform.

12. Governing law

These Terms are governed by the laws of the Federal Republic of Germany. The venue for disputes is Hof, Germany, unless mandatory consumer protection laws provide otherwise.

13. Age requirement

You must be at least 16 years old to use OnlyAI.fm. By using the service, you confirm that you meet this requirement.
